Believe it's a burbank spineless.
Sometimes the plant overgrows onto the sidewalk and then it can be picked. However, it gets pruned - so it's not always that way.
The owner gives permission to pick the cactus on their land. I got permission to pick from them - so it seems they want people to. Otherwise it just ends up falling to the ground.
